1. Tharavad Ayurveda Retreat (hereinafter referred to as ”Tharavad” ) is the owner of the website: tharavad.co.in(“platform”). Tharavad is offering an online platform whereby you can address your health-related issues by consulting the Doctors / Physicians available on the platform. The terms “your doctor”, “your physician”, “your medical consultant” shall, at all times, only mean the Doctor / Physician / Medical Consultant whom you are consulting on the platform and shall not in any manner mean Tharavad.
2. Your use of the platform is governed by these Terms of Use. By accessing, browsing or otherwise using the platform from a computer or mobile phone device (through an IOS or Android application), you agree to be bound by these Terms of Use¸ whether you have read the same or not. The platform is only to be used for your personal non
commercial use and information. If you are not agreeable with these Terms of Use / or any other Policies, please do not use the platform.
3. Tharavad reserves the right to unilaterally change, modify, add or remove portions of this Terms of Use and other Policies, if any, at any time without any prior written notice to you, at its sole discretion. Any change / modification to these Terms of Use and / or Policies will be effective immediately from the date of uploading the same. It is your responsibility to review these Terms of Use periodically for viewing the updates/ changes to these Terms of Use. Your continuous use of the platform, following the modifications, constitutes your acceptance of the same, whether you have read it or not. As long as you comply with these Terms of Use, Tharavad grants you a personal, non- exclusive, non-transferable, limited privilege to enter and use the platform.
4. You must be “competent to contract” within the meaning of the Indian Contract Act, 1872. Persons who are incompetent to contract including un-discharged insolvents etc. are not eligible to use the platform.If you are accessing, browsing and using the platform on someone else’s behalf; you represent that you have the authority to bind that person to all the terms and conditions herein and have express authority from such person to use the platform on his / her behalf for him / her. If the person refuses to be bound to the Terms of Use, you agree to accept liability for any loss, damage and / or harm caused by the wrongful use of the platform by you resulting from such access or use of the Website in whatsoever nature.
5. . If you are a minor i.e. under the age of 18 years, you may use the platform only under the supervision of a parent or legal guardian or your parent/ legal guardian can transact on your behalf.
6. You agree and acknowledge that Tharavad is only providing a platform whereby you can consult with various Doctors / Physicians available on the platform regarding your health-related issues. The platform does not replace “Doctor-Patient relationship”.
7. Tharavad recommends a list of Doctors / Physicians to you and you agree and acknowledge that Tharavad does not promote or recommend or endorse any one particular Doctor / Physician to you. Tharavad makes no warranty for any damage suffered by you from use of the consultation services. Furthermore, Tharavad makes no warranty that medical consultation on this platform is a substitute to in person consultation.
8. For selecting your medical consultation, you will have to select a particular date of your preference for the consultation and you will be made aware of the available time slots
for your appointment. Upon selecting and confirming a particular date and time slot, you shall receive an email from Tharavad recording that you have booked a medical consultation for that particular date and time slot and further the email shall specify the name of the doctor who shall be consulting you.
9. In the event, Tharavad cancels your confirmed appointment for any reason, including, without limitation, unavailability of the Doctor/ Physician, etc., Tharavad shall notify you regarding the same 1 Hour prior to your scheduled appointment.
10. You agree and acknowledge that you are availing the services on the platform out of your free volition with complete knowledge of any and all of your medical issues, including, without limitation, side effects to medication, allergies, etc. You shall not hold Tharavad liable for any loss, damage or harm which is or may be caused to you owing to availing the services on the platform.
11. You agree and acknowledge that prior to and during your consultation, there will be certain information, which is personal to you, which you will share with Tharavad / Doctor(s) / Physician(s). You agree and acknowledge that Tharavad reserves the right to retain the information provided by you to maintain your data, medical history, etc.
12. You represent and warrant that the information provided by you for the purpose of diagnosis and treatment is accurate and is not misleading, false or incomplete. You agree and understand that in the event the information is inaccurate, misleading, false or incomplete, then the Doctor / Physician may not be able to provide an accurate diagnosis and treatment. You shall not hold Tharavad liable for any loss, damage or harm which is or may be caused to you owing to the same.
13. You agree and acknowledge that the Doctors / Physicians associated with the platform consult / advise you and / or prescribe medication and / or tests purely on the basis of their experience and expertise in their field of practice, which is their independent opinion / advise.
14. During your consulting session, you may be provided with prescription(s) by the Doctor / Physician whom you are consulting. You agree and acknowledge that the prescription provided to you by the Doctor / Physician may not accepted by all pharmacies. Tharavad is not responsible or liable in any manner whatsoever in relation to the medicines / products prescribed to you by the Doctor / Physician.
15. Tharavad does not promote or endorse any particular procedure or test. Any advice given by the Doctor / Physician during the consultation in relation to any procedure or test is his / her independent advice based on your diagnosis.
16. You agree and acknowledge that the consultation sought by you is personal in nature. You undertake not to provide the advice availed by you to any other person / entity, commercially or otherwise. Tharavad shall not be liable for any loss, damage or harm which is or may be suffered by any person owing to such act. You agree that the services availed by you are not transferable in nature.
17. You agree and acknowledge that the utilization of the platform is not meant in cases of emergency or critical health circumstances which require immediate medical action. You are advised to visit a hospital or avail immediate face-to-face interaction with a health professional. You shall not hold Tharavad liable for any loss, damage or harm which is or may be caused owing to your delay in availing immediate medical attention in circumstances of emergency.
18. You agree and understand that during consultation, the Doctor/ Physician may not have the benefit of all the information which is provided during a face-to-face consultation such as facts relating to medical history, allergies, etc. You agree that the information provided by you is limited and may not be complete information. Therefore, you are always advised to seek a second opinion during a face-to-face consultation especially in the event you suffer from any allergies or side-effects or do not feel treated post the treatment.
19. The platform is provided on an “as is” and “as available” basis. Tharavad makes no representation or warranties of any kind, express or implied, as to the operation of this platform or the information, content, materials or products shown on this platform. You expressly agree that that your use of the platform is at your own risk. Tharavad do not warrant that the platform, its server or email sent are free of virus or other harmful components. Tharavad will not be liable for any damages of any kind arising from the use of this platform, including but not limited to direct, indirect, incidental, punitive and consequential damages.
20. All disputes in connection with these Terms of Use shall be construed and governed in accordance with Indian laws and shall be subject to the exclusive jurisdiction of the competent courts at Kerala only.
